Lisa Abe and Maggie Gwiazda will discuss industry and private practice experiences regarding the treatment of open source software in software development and in IT transactions. Lisa and Maggie will also discuss the recent case of Jacobsen v. Katzer in the Court of Appeals for the Federal Circuit in the US, a case which is the first real test of the remedies for breach of open source licenses in US courts.

Maggie is a Senior Intellectual Property Law Attorney at IBM Canada Ltd. where she supports IBM’s business teams in negotiating contracts for new engagements. Maggie is involved in drafting and negotiating IP indemnities, warranties, licenses and advises on the retention/transfer of IBM’s IP in transactions. Maggie is called to the bar of Ontario and New York and is a U.S. Patent Attorney. Prior to joining IBM in 2007, Maggie was an associate at the prominent New York law firm of Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C., where she was involved in patent, copyright and trademark litigation, and advised international clients on IP issues in business transactions.
